A BILL to a amend article twenty-three, chapter nineteen of the
code of West Virginia, one thousand nine hundred thirty-one,
as amended, by adding thereto a new section, designated
section nine-a, relating to horse and dog racing; requiring
designation of one racing day for which the commission is to
be used to assist students with disabilities attending state
colleges and universities.
Be it enacted by the Legislature of West Virginia:
That article twenty-three, chapter nineteen of the code of
West Virginia, one thousand nine hundred thirty-one, as amended,
be amended by adding thereto a new section, designated section
nine-a, to read as follows:
ARTICLE 23. HORSE AND DOG RACING.
ยง19-23-9a. Special racing days for higher education.
(a) Notwithstanding any provision of this article to the contrary, the racing commission may designate one of the existing
racing days, in the year, one thousand nine hundred ninety-eight,
at each horse racetrack and dog racetrack as "state college and
university day." The commission that would otherwise be deducted
by the licensee from the pari-mutuel pools, pursuant to section
nine of this article, shall, on that day be paid into the fund
created in subsection (b) of this section.
(b) All moneys collected pursuant to subsection (a) of this
section shall be deposited in a special account in the state
treasury to be known as the "state college and university
students with disability fund." Expenditures from the fund
shall be for the purposes set forth in this section and are not
authorized from collections but are to be made only in accordance
with appropriation by the Legislature and in accordance with the
provisions of article three, chapter twelve of this code and upon
fulfillment of the provisions of article two, chapter five-a of
this code. The joint committee on government and finance shall
approve how the funds are allocated to the state colleges and
universities. Amounts made available from the fund may only be
used to fund direct services to students with disabilities.
(c) The racing commission shall review the results of the
race day designated in subsection (a) of this section and submit
any recommendations it has to the joint committee on government
and finance by the tenth day of January, one thousand nine hundred ninety-nine.
NOTE: The purpose of this bill is to designate one racing
day at all horse and dog racetracks as "state college and
university day." The commission that would normally be kept by
the racetrack on that day is to be deposited into a special fund
to help provide services to assist students with disabilities at
state colleges and universities.
